		<p style="text-align: left;"><span style="font-weight: 400;">Owning a property in Canada comes with responsibilities, and there&#8217;s something that many homeowners are not aware of: the Underused Home/Housing Tax, or UHT.</span></p>
<p style="text-align: left;"><span style="font-weight: 400;">Effective from January 1, 2022, the Government of Canada introduced the Underused Home/Housing Tax, which targets vacant or underused properties in Canada to optimize housing supply. While it mainly affects non-resident, non-Canadian owners, Canadian homeowners might also be subject to this tax in certain situations.</span></p>
<p style="text-align: left;"><span style="font-weight: 400;">Now, let&#8217;s understand who needs to file a UHT return. If you&#8217;re not an &#8220;excluded owner,&#8221; you must file an annual UHT return for each residential property you owned as of December 31 of the previous year. Excluded owners include Canadian citizens, permanent residents, publicly traded Canadian corporations, and specific entities like registered charities, universities, hospitals, and Indigenous governing bodies. Attention: PRIVATE companies are NOT excluded owners. So if you own a property under a Canadian corporation that is not publicly traded, you might be required to file. </span></p>
<p style="text-align: left;"><span style="font-weight: 400;">Exemptions from paying UHT may apply depending on various factors. If your property is your primary residence or occupied for a certain period, you might be exempt.</span></p>
<p style="text-align: left;"><span style="font-weight: 400;">The UHT is calculated at a rate of 1% on the &#8220;taxable value&#8221; of the property. This value can be based on the highest between a government assessment and the recent sale price, or the fair market value of the property supported by an appraisal.</span></p>
<p style="text-align: left;"><span style="font-weight: 400;">Although you might not have to pay for UHT you might still be required to file. So It’s essential to file your UHT return by April 30th every year. This year CRA extended the Underused Housing Tax Deadline to October 31, 2023. Failure to do so can result in penalties, starting at $5,000 for individuals and $10,000 for corporations, with additional monthly penalties. We’d recommend that you speak to your accountant to see what’s applicable to you since you are still on time to file if this is the case.</span></p>

All prices and fees related to the properties used for the analysis are an average of  sales and leases that took place in Downtown Toronto (Districts C01 and C08 &#8211; Waterfront Communities &#8211; that means South of Bloor St and between Liberty Village and the Don Valley Parkway), in the last 30 days. Keep in mind that every location and property can have a different dynamic, and averages are not necessarily indicative of the situation of your property or one you want to purchase.</p>

Tons of [clickbait] articles are being written and we want to help give you peace of mind. Rest assured that wherever you are on the real estate ladder: if you are a buyer, a seller, a landlord or a tenant, you have made the right decisions so far. What matters is what you will do next.</span></p>
<h4><b>For Buyers: </b></h4>
<ul>
<li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">Panic buying is over (for now).  It is true however, that properties in great locations and with unique characteristics, are still driving more than one offer and selling above the asking price &#8211; and slightly above in some cases &#8211; so it is [yet and it always will be] advisable that you have your pre-approval in place and all your documents sorted out. That way you will be ready to move on once we find the perfect home for you.</span></li>
<li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">You have more choices. Although inventory remains low, or at least what we like to call &#8220;quality&#8221; inventory, and depending on your budget, Buyers can now explore the options out there, breathe easier and have more space to make a decision. </span></li>
<li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">It is true that interest rates have largely affected the affordability of many buyers, but you still have the option to get into the market. You can now choose your rate (not a fixed one though) and go out to find your home.  As rent prices hit an all-time high, it is worth considering buying vis-à-vis the historical upward trend in Toronto real estate prices. </span></li>

<h4><b>For Sellers:</b><span style="font-weight: 400;"> </span></h4>

<li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">Forget about the value of your home or if you &#8220;missed&#8221; the train for not selling in February 2022. If you&#8217;re thinking about your home&#8217;s value based on what happened in the first quarter of this year, you are using an approach that will not help you to gain perspective of the market. We are certain that if you had the fortune of buying with us at any time in the last 10 years, you obtained the best price and conditions by the time you put your offer in. </span></li>
<li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">Prices are solid and holding their ground because we are not being flooded with inventory and because our city drives most of the housing demand in Ontario. The adjustment in prices is temporary and you can congratulate yourself for owning a home in Toronto.</span></li>
<li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">If you are on a variable rate mortgage and have reached the threshold rate, cut on unnecessary expenses and adjust your finances to &#8220;ride the wave&#8221; for now. This too shall pass and the rates will not remain high forever. Trust the fact that your home is shielding you and your money from inflation and helping to create wealth for you and your family down the road.</span></li>

<p><b>Vacant Home Tax</b></p>
<p><span style="font-weight: 400;">As of January 1st, 2023 ALL residential property owners in Toronto will be required to declare the occupancy status of their property(ies) for the previous year. The goal of the City of Toronto is &#8220;</span><i><span style="font-weight: 400;">increase the supply of housing by discouraging owners from leaving their residential properties unoccupied. Homeowners who choose to keep their properties vacant will be subject to this ta</span></i><span style="font-weight: 400;">x&#8221;.</span></p>
<p><b>When:</b><span style="font-weight: 400;"> The deadline is February 2, 2023</span></p>
<p><b>How:</b><span style="font-weight: 400;"> The online declaration portal is NOW open. Visit this link and click on the </span><b>SUBMIT DECLARATION </b><span style="font-weight: 400;">button</span><b>.</b></p>
<p><span style="font-weight: 400;">Keep in mind that:</span></p>
<ul>
<li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">A property is considered vacant if it has been unoccupied for more than six months during the previous calendar year or is otherwise deemed to be vacant under the bylaw.</span></li>
<li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">Revenues collected from the Vacant Home Tax will be allocated towards affordable housing initiatives.</span></li>
<li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">The Vacant Home Tax is 1% of the Current Value Assessment (CVA)</span></li>
<li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">The tax is based on the property’s occupancy status for the previous year. For example: for a home vacant in 2022, the tax will become payable in 2023.</span></li>

<li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">It is the responsibility of purchasers and vendors to make the appropriate arrangements to ensure that the declaration has been filed. When buying a property with a closing date happening before February 2 in any year (for now) </span><b>you must make sure and confirm with your lawyer that the seller has already made this declaration BEFORE closing. Otherwise any unpaid taxes will become the purchaser&#8217;s responsibility.</b></li>
</ul>
<p><b>Foreign Buyers Ban </b></p>
<p><span style="font-weight: 400;">On June 23, 2022, Parliament passed the Prohibition on the purchase of residential property by non-Canadians Act which will come into force on January 1st, 2023. Based on interpretation of the Act the language suggests that the prohibition applies to agreements entered into after January 1, 2023.
